Prayagraj, 08 May (HS). The Allahabad High Court has imposed a compensation of Rs 25,000 on the person who filed the PIL while hiding the fact of the pending case and has rejected the petition.

The petitioner filed a PIL seeking compliance of the demolition order passed by the respondent authorities. It was argued that the land in question should have been a park. Where the construction work was done by the opposite respondents. The petitioner said that even though the demolition order was passed, it was not implemented for a long time.

The opposite party appeared before the court and submitted that the land in question was registered in his name and the appeal filed by the petitioner against the land being registered in his name was rejected by the Sub Collector. The commissioner also rejected the revision against the order of the Deputy Collector. It was submitted that a writ petition had also been filed against the order of the Commissioner which was pending before the High Court. Argued that the petitioner has hidden the facts related to the pending case in his PIL.

The court observed that when the petitioner’s counsel was asked about the pending suits, he said that they were in relation to a different land. However, records show otherwise. The division bench of Chief Justice Arun Bhansali and Justice Vikas Wednesday, while passing the order in the case of Ram Surat vs UP Government and others, said that “Clearly, the present petition has been filed concealing the interrelated litigations and the petition has been filed as a PIL. has been used to demand implementation of the order against which an appeal is pending between the parties. An order has been passed on that by the competent court. The above conduct of the petitioner cannot be tolerated.

The court rejected the PIL and imposed a fine of Rs 50 thousand. The petitioner will have to deposit Rs 25,000 with the State Legal Services Authority of Allahabad High Court.
