Wrong information may have to be given heavy for job, big decision of Supreme Court: Know what are the rules

The Supreme Court has recently given an important verdict. According to this, if an employee gives any wrong information related to his fitness or ability to get a job, and that information is necessary for his job eligibility, then he can be fired. The decision came during the hearing of the case associated with two CRPF soldiers, who were fired from the job due to misinformation. Justice Suryakant and Justice J.B. Pardiwala’s bench emphasized that there should be complete transparency especially in recruitment like police.

Appointment is not confirmed even after being acquitted in criminal case

The court made it clear that just because a candidate has been acquitted in a criminal case, he does not get himself right to get a job. The employer will still have the right to decide whether the candidate is worth that post by investigating. He cannot be forced to give a job to the candidate.

The court also said that the purpose of asking for information in verification form (verification letter) is the same whether the Character and Background of the candidate can be tested to know whether it is right for the job or not.

Information may be expensive to hide

A bench of the Supreme Court said that hiding a serious or important information or misrepresenting questions related to criminal cases, directly questions the candidate’s character, conduct and his past record. While recruiting government jobs, especially police forces, the employer should closely investigate every case.

Employer’s investigation process will also be tested

A bench of Justices Suryakant and Justice Pardiwala also clarified that courts would ensure that the employer (Employer) did not make any mistake or bias while dismissing the candidate. In addition, the process that the employer adopted to examine the candidate should also be reviewed, so that no one is injustice.
