Supreme Court Has sentenced the accused of raping a 10 -year -old girl in Gujarat to 10 years after 32 years. Earlier, the lower court of Gujarat acquitted the accused. After about 30 years, the High Court overturned and sentenced the lower court verdict last year. Now the Supreme Court has also upheld the High Court’s decision and upheld it. The 54 -year -old man has been sentenced in this case.
What was the incident?
Let us tell you that, exactly one year after this incident, the Additional Sessions Judge of Ahmedabad Rural released the accused in October 1991. The person was accused of raping the victim in a field. The victim was then taken to the hospital. Later, an FIR was lodged against the accused with the help of sarpanch. Medical examination confirmed the rape. It is noteworthy that the age of the accused was 21 years at the time of crime.
Which foolish judge allowed the accused to go?
The lower court acquitted the accused on a delay in filing an FIR without considering the circumstances. The trial court said that there was a delay of 48 hours in filing the FIR. The state government then filed an application in the High Court, which was pending for 30 years. Later on 14 November 2024, Justice Anirudh P. My and Divyesh A. Joshi overturned the trial court’s decision. In addition, the accused was sentenced to 10 years imprisonment and a fine of Rs 10,000 under sections 376 and 506 of the IPC. The case was then challenged in the Supreme Court, where the court upheld the High Court’s verdict and criticized the Sessions Court’s verdict, saying, “I want to know, I want to know which foolish judge finally released the accused even after the report of forensic science laboratory?” Even the statements of a doctor and pediatrician were ignored.
