Delhi Court: The court acquitted seven women accused of performing obscene dancing in the bar. The court said that the prosecution failed to prove that there was a crime in the case.

Wearing short clothes is not a crime.

Tris Hazari -based Chief Judicial Magistrate Neetu Sharma said that wearing short clothes is no longer a crime and a song cannot be fined for dancing. Even if the dance is done publicly.

The officer has not claimed this anywhere.

The court said that anywhere in the case, the police officer did not claim that the dance was harassing another person. Two prosecution witnesses also said in their statement that ‘We had gone to that place for entertainment and we do not know anything about the matter.’

Public support was not received

The court said that it is clear that the police created the story, but it did not get the support of the public. In such a situation, even if the claim of SI is accepted once, it does not establish the nature of crime. The court also questioned the failure of the police in involving others present in the investigation.

 

The court also acquitted the bar manager, who was accused of not properly maintained the CCTV cameras in the bar, violating the order issued by ACP, Paharganj under Section 144 of CRPC. The court said that there was no such charge.

The court said that the prosecution failed to present any evidence to show that the notice was ever issued or the accused was aware of the order issued by the ACP. The court also said that there is no such allegation that the said time was being run in violation of the provisions and guidelines issued by the government without a proper license.

The Pahadganj police registered a case against women under Section 294 of the Indian Penal Code, under which any pornographic act committed with the intention of harassing someone else in a public place is considered a crime. The case was registered on a complaint of a sub-inspector (SI), who claimed that the matter came to know that he came to know during patrolling in the area. He alleged that when I entered the bar, I saw that some girls were wearing short clothes and dancing on porn songs.
