Waqf Matter: Supreme Court reached the Supreme Court of demolition of the dargah in Dehradun, sought a reply from the state government

News India Live, Digital Desk: Waqf matter: A hearing was held on Tuesday in a case related to the Waqf revised law. During this, the apex court issued a notice to other parties including the Uttarakhand government. A bench of Justice BR Gawai and AG Christ has sent a notice. While filing an application in the court, on April 17, the assurance given by SG Tushar Mehta was accused of violating. The application states that despite the assurance of SG, the registered Waqf property was demolished.

In fact, Mahfooz Ahmed of Uttarakhand has filed a contempt petition in the Supreme Court against the violation of the government’s assurance in the Waqf case. The residents of Dehradun claim that the state administration demolished the dargah without any notice, while the government assured not to implement the Waqf amended law in the Supreme Court.

This contempt case in the Supreme Court is about demolishing the Dargah Hazrat Kamal Shah Dargah late on 25 April without any notice. The petition said that Dargah Hazrat Kamal Shah was registered in the year 1982 as Sunni Central Board of Waqf, Lucknow, Uttar Pradesh as Waqf Property No. 55 Dehradun.

‘Action taken on the basis of complaint on CM portal’

The petitioner says that the alleged action was taken on the basis of a trivial complaint taken on the Chief Minister’s portal. He cited a media report, according to which Uttarakhand CM Pushkar Singh Dhami has said that the state government will conduct a comprehensive investigation into 5,700 Waqf properties registered in Uttarakhand to identify encroachments and ensure strict action if found in violations.

The petitioner has also included the November 2024 verdict of the apex court in the bulldozer case, stating that no one should be sabotaged without a show notice according to the time given in the local municipal laws or within 15 days from the date of service.
