Waqf Amendment Bill 2025: Passed by Parliament, Law will be made after President’s approval

The Waqf Amendment Bill 2025 has been approved from both houses of Parliament – Lok Sabha and Rajya Sabha. Now this bill is waiting for the approval of President Draupadi Murmu. After the President’s consent, this bill will take the form of law and significant changes will be made in the Waqf Act.

When will this law apply?

According to Advocate on Record Fujail Ahmed Ayubi in the Supreme Court, after the President’s approval, the Central Government will issue a notification, which will be told from which date the revised law will be applicable. Since that date, this bill will become an effective law of the country.

Now the method of monitoring Waqf properties will change

Ayubi said that several sections of the Waqf Act have been canceled in this amendment bill. For example, earlier the right to determine the Waqf property was only with the Waqf Board, but now this provision is being removed. Instead, the collector will be given the responsibility of the investigation process.

According to the rules, a nominated officer will be appointed before the government properties declare the assets as Waqf property. Separate rules will be made to clarify the role, jurisdiction and tenure of this officer.

Changes will also come in survey and application process

The collector will now be given the right to survey Waqf properties. Detailed guidelines and rules will be required to conduct this process. In addition, the new format will also be finalized to submit applications related to Waqf properties.

According to Advocate Ayubi, the format of the application format has already been mentioned in sections 3A, 3B and 3C of the Act, but detailed rules will be required to implement it.

Draft rules and time limit

The draft these rules will be prepared by the Union Ministry of Minority Affairs. It will be mandatory to publicly publish these rules within six months of the law. In some cases the deadline can be extended.

For the rules for which public counseling is required, a time period of at least 30 days is fixed so that the public opinion can be taken.

Opposition in the shelter of Supreme Court

AIMIM chief Asaduddin Owaisi has already turned to the Supreme Court regarding the bill. Now MP Pappu Yadav has also reacted to this issue. He said, “When the House becomes deaf and dumb, then there is no option other than the Supreme Court. The Constitution is supreme and any person can go to the Supreme Court if it is violated.”
