Bengaluru vs Hyderabad: The IPL team Royal Challengers Bangalore (RCB) approached the Delhi High Court on Thursday. The RCB filed a petition in the High Court alleging that an advertisement of YouTube was violating its trademark. The case is related to Uber Moto and Australian batsman Travis Head. Justice Saurabh Banerjee reserved his order after hearing the arguments of both sides on the interim application of RCB.

Royal Challengers Sports Private Limited filed a case against Uber India Systems Private Limited, alleging that Uber Moto’s YouTube advertisement violates his trademark. The title of this advertisement is ‘Badies in Bangalore feet Travis Head’. RCB said that the main character in the video, Sunrisers Hyderabad cricketer Head insulted his trademark.

RCB said, “The main character in the video, Sunrisers Hyderabad opener Travis Head insults his trademark.” Talking about the video advertisement, the RCB counsel said, “The cricketer is shown riding a bike towards the Bengaluru Cricket Stadium.” Its purpose is to spoil the poster of the match “Bangalore vs Hyderabad”. He took spray paint and wrote ‘Royley Challenge’ ahead of Bengaluru, which made it ‘Royley Challenge Bangalore’, which is an insult to RCB’s trademark. ‘

 

The lawyer argued that any negative remarks are derogatory and said, ‘Uber Moto, commercial sponsor of Sunrisers Hyderabad IPL team, used RCB trademark during his business to promote his product, which is ride booking, is also unacceptable under the law. Meanwhile, a lawyer representing Uber said that RCB has given “less importance” to common people’s humor. The general message of the advertisement was that on 13 May, there is a match between RCB and Sunrisers Hyderabad in Bengaluru. Since traffic in the city is very high, people should use Uber Moto.

Uber’s lawyers said, “Good humor, fun and jokes are an integral part of advertising messages.” If the standard proposed by RCB is implemented, these factors will “disappear”. This advertisement has been viewed more than 1.3 million times so far.
