Vice President Jagdeep Dhankhar has reacted strongly by the Supreme Court to direct the Bills to take a decision on the Bills within three months. He said that there is no such system in the Constitution of India under which the judiciary can direct the President. He gave this comment while addressing the sixth batch trainees of Rajya Sabha.
Dhankhar questioned the role of the judiciary, saying, “Will we now have judges who will enact laws, will work for the executive and stand above the Parliament? And because the law of the country does not apply to them, so they will not be accountable?”
‘Nuclear missile’ told Article 142
Dhankhar described Article 142 of the Constitution, which provided special powers to the Supreme Court, described the ‘nuclear missile available round the clock against democratic forces for the judiciary’. He said that this power challenges the balanced structure of democracy.
Under Article 142, the Supreme Court has the right to order to ensure ‘complete justice’ in any case. Describing it as highly powerful, the Vice President said, “We have reached at a time where time -bound orders are being given to the President. If the President does not do so, it becomes a law. Did we think this form of democracy?”
Emphasis on the dignity of constitution and presidency
Dhankhar underlined the constitutional stature of the President, saying that he takes an oath of protection, security and protection of the Constitution, while other constitutional officials take an oath to follow it only. He said, “On what basis can you instruct the President of India? The Constitution only gives you the right to explain the constitution under Article 145 (3), that too through a back of five or more judges.”
Dhankhar said that he never thought in his life that he would have to see such a day. He also said that in the current situation the country should be very sensitive and cautious as it can affect the basic structure of democracy.
