Bhopal (Madhya Pradesh): The bill related to Model Tenancy Act will not be tabled in the Winter Assembly session which is beginning today (Monday). The Urban Administration Department (UAD) has decided to compare the draft of the proposed MP Tenancy Act 2024 with the Madhya Pradesh Tenancy Act 2010.
For the past couple of years, the bill related to the new Tenancy Act has been pending. People aware of the development said that UAD aims to plug any loopholes in the draft of the Model Tenancy Act 2024 by comparing it with the MP Tenancy Act 2010, known as the MP Parisar Kriyadari Adhiniyam.
The 2010 Act was prepared to remain effective for a duration of two years, whereas the proposed Act has no time limit. The old Act and the proposed draft have several common provisions. Like the previous Act, the proposed draft bill also entails that no tenant shall, without the consent in writing of the landlord, sublet whole or any part of the premises held by him as a tenant.
However, a new provisions have also been included in the proposed draft bill like previous Tenancy Act says that from every final order passed by rent tribunal, an appeal shall lie to the Appellate Rent Tribunal, within the local limits of whose jurisdiction the premises is situated and such an appeal shall be filed within 30 days from the date of final order along with copy of the final order.
However, the proposed draft bill says that any person aggrieved by the order of the Rent Authority may appeal to the Rent Court having territorial jurisdiction.
The provision of draft of new act states that notwithstanding anything in the agreement to the contrary, the landlord and the tenant shall keep the premises in as good a condition as the commencement of the tenancy, except the normal wear and tear and shall respectively be responsible to repair and maintain the said premises as specified in the second schedule or as agreed to in the tenancy agreement.
