Mumbai – The Bombay High Court has ordered the Mumbai Municipal Corporation to stop Jain Derasar in Vile Parle from further breaking. The court gave this relief on an appeal filed against the municipal action by the Municipal Trust by Shri 1008 Digambar Jain Temple Trust. Justice. Gauri Godke has given protection from action to Derasar till the next hearing on 30 April. The court emphasized the appeal on the appeal on the appeal and the rights of the appellant for rational orders.

There was a dispute over the sabotage work done by the municipality on the basis of the notice issued under the Mumbai Municipal Corporation Act and Maharashtra State Urban Planning Act. The City Civil Court had earlier rejected the trust’s application for interim protection verbally, but extended the adjournment to seven days till April 15.

Immediate hearing was requested as the municipal officials and police were present at the sabotage site. The court said that partly demolition has been done but the main structure remains intact. The municipality has been asked to submit a report of demolition within two weeks.

The court has ordered the municipality to stop further further sabotage and asked the adjournment order of 16 April to be followed by 30 April till further orders.

The court said that the appellant has not yet received a decision on his application, so he is entitled to hearing. The demolition work was in its initial stage when the court intervened. Therefore, interim protection is provided and the municipality has been ordered to stop sabotage until the next order of the court.

The municipal counsel told the court that most of the structure except two walls had been demolished, and their statement was accepted. The municipality has been given two weeks more time to submit an affidavit with documents.
