Mumbai: A special court here has refused to take cognizance of the CBI chargesheet against two traders in the DHFL-bank fraud case. Special Judge Asidaga said on 13 March that the allegations against the two traders have not been clarified.

The CBI filed a fourth supplementary charge sheet in the special court. The CBI has accused Vinod Goenka, Shahijad Balwa and 12 others, causing a total of 41 accused in the case.

The CBI had said that Goenka and Balwa had sent it elsewhere instead of using funds for the purpose for which the loan was taken from DHFL.

Special Judge A.C. Daga has refused to take cognizance of the charge sheet against two traders and stock market operators Sanjay Dangi. The court said in its order that the prosecution has accused Goenka and Balwa of fraud and embezzlement (cheating and embezzlement).

The court found that his name was not mentioned in the first supplementary chargesheets or first information report (FIR). For the first time in the fourth charge sheet, his name was registered as accused.

The court said that “It is necessary to establish a prima facie a case for the prosecution to implement the legal provisions against the meeting and the conspiracy (fraud and conspiracy) that it was necessary to cheat from the beginning.” In this case, this is not shown anywhere in the record. While taking a loan from DHFL, the accused intended to fraud.

The court said that no case can be made against these two traders and there is no basis for fraud allegation against Dangi. The court said that a case of cheating and forgery has been registered against one absconding accused and two others.
