Kerala High Court News: The Kerala High Court has said that the perception is wrong that Indian women can never file false complaints of physical abuse. The High Court also said that there has been an increase in the number of women who have filed false cases in the last few years in an attempt to equalize men. The High Court made this comment during the hearing of a rape complaint by pretending to be married.
Justice A Badrudi of the Kerala High Court said that such false cases are increasing, so it can be said that the belief that women can never register false cases should not be added to all cases. The accused appealed to the Kerala High Court against the rape complaint under Section 376 of the IPC.
In the case, it was alleged that the woman made a false promise of marriage and made a relationship with her and later claimed that she raped her. On the other hand, the woman, who filed a rape complaint against her former partner, stunned the court, taking a U-turn in the court, saying that if the proceedings against the accused are dismissed, she has no objection. Meanwhile, the government prosecutor said that the complaint cannot be dismissed as the woman herself said that she has been raped.
The High Court later mentioned that the incident took place in 2014 and the crime report was reported in 2019. The woman lodged a complaint in 2016 but could not be investigated as the accused person promised to marry at that time. It is difficult to say whether the woman’s complaint is actually based on facts or not. The High Court later accepted the appeal and ordered to cancel all the proceedings against the accused. During this time it was found that it is wrong to assume that women cannot file false complaints.
