Surrogacy Ban in Italy: The Italian government has banned surrogacy. A new law has been passed in Italy regarding this. According to this law, it will be considered a crime for Italian citizens to use surrogacy abroad also. The new law makes surrogacy a ‘universal crime’, categorized as a crime against humanity. This law has been in place in Italy since 2004, but this new law tightens restrictions on surrogacy.

Italian Prime Minister Giorgia Meloni described the law as ‘common sense’ and said it would protect women and children from ‘commercialisation’. However, many people consider this law to be against the rights of women and children.
Which countries ban surrogacy?
Laws prohibiting surrogacy vary from country to country. There are some countries where surrogacy is completely banned. These include Italy, France, Germany, Switzerland and Spain. While there is a partial ban in countries like the UK, Australia, Canada, India and the US, surrogacy is allowed, but with certain conditions and restrictions.
Such is the rule of surrogacy in India
If it comes to surrogacy in India, surrogacy is regulated under the Surrogacy (Regulation) Act, 2021. While commercial surrogacy is banned in India, it can be done just to help. Also, foreign couples cannot come to India and do surrogacy. There are many conditions for surrogate mother, like only a close relative can become a surrogate, who already has a child and is between 25 to 35 years of age. Apart from this, the clinic will also have to state that they support surrogacy.
