The Supreme Court is taking a tough stance on running bulldozers across the country including Uttar Pradesh. In Prayagraj, in 2021, the houses of a lawyer, a professor and three women petitioners were demolished by bulldozers. Hearing the case, the Supreme Court on Tuesday said that the process of demolishing the house is unconstitutional. The court said that this arbitrary process of demolishing houses is also a severe violation of civil rights.

 

Compensation of 10 rupees to five victims

The court said that it shakes our conscience and it is a case called right to shelter. In this context, the court said that there is something called notice and other appropriate process, which has not been followed. The court has ordered the Prayagraj Development Authority to give compensation of Rs 10 lakh to the five victims.

The court heard the petition of advocate Zulfikar Haider, Professor Ali Ahmed and others.

 

The Supreme Court said that the way inhuman and illegal measures were adopted in the way it was vandalized, compensation is being given. The Supreme Court said that the demolition action is completely illegal and a violation of the right to asylum. The Supreme Court said that such barbarity reflects the insensitivity of the Prayagraj Development Authority.

The Supreme Court said that the manner in which was vandalized was inhuman.

 

During the hearing in the same case, Justice Ujjwal Bhuiyan, while referring to the incident in Ambedkar Nagar, UP, said that on one hand, bulldozers were being run on the huts during the anti -encroachment campaign, while on the other hand an 8 -year -old girl was running away with her books. This picture shook everyone, this is an unfortunate situation, where illegally vandalizing and people involved do not have the ability to do construction work.

The bulldozer started working 24 hours after the notice.

The petitioners said that they were not given any notice before the proceedings. Bulldozers were run within 24 hours of sending the notice. According to the petitioners, he was first given notice on 1 March 2021 and received notice on 6 March. Then, the next day, on March 7, the action of bulldozers was taken on the houses.

The court heard the petitions of advocate Zulfikar Haider, Professor Ali Ahmed and others whose houses were demolished. The petitioners argued that the administration and the government feel that the property is of gangster and political party leader Atik Ahmed. All these people filed a complaint in the Allahabad High Court. But the High Court dismissed their petition challenging the demolition of the building. The petitioners approached the Supreme Court after the petition was dismissed by the High Court.
