The Supreme Court has imposed a temporary stay on the order of the National Green Tribunal (NGT) in which the Bihar government was fined Rs 50,000. The fine was imposed due to prevention of pollution in the Ganges and not to follow the instructions required for prevention and control and not providing proper assistance.

What was the order of NGT?

In its order issued by NGT on 15 October 2023,

  • The Chief Secretary of Bihar was asked to appear through a video conference to inform about the steps taken for pollution control in the Ganges river.

  • The Bihar government was fined Rs 50,000 for failing to stop water pollution in the Ganges and its tributaries.

Supreme court response

Justice B. R. A bench of Gawai and Justice Augustine George Christ heard the petition of the Bihar government and issued a notice to the Central Government and other stakeholders in the case asking them to file a reply within four weeks.

The Supreme Court said in its order, “By next order, the disputed order of the NGT will be stayed.”

NGT initiative on Ganga river pollution

The NGT is constantly monitoring the Ganges River and its tributaries to prevent water pollution.

  • State -wise reviews are being done on this issue, including all the states and districts from which Ganga and its tributaries flow.

  • The NGT had earlier issued instructions to improve the water quality of Ganga and its tributaries in Bihar.

This decision of the Supreme Court will now determine further legal process in this case.
