London : The Supreme Court of Britain has given a shocking verdict regarding the transgender community. According to the court, transgender persons will not be legally recognized as women. This is likely to have a major impact on transgender rights. Many legal and social disputes are likely to arise.

Debate on being a woman

According to the information received, the Scottish government introduced a law in 2018. Under this law, at least 50% female representation was mandatory in public institutions. According to this law, transgender women with gender identity certificate were also considered women. But for the Boomers Scotland Group opposed this law. The group said that this is changing the original definition of women.

 

Court decision

In 2022, the ‘For Women Scotland’ group filed a petition in the Supreme Court after losing the case in the Scottish courts. A bench of five judges of the Supreme Court unanimously gave a decision. According to this decision, the words “women” and “gender” under “Equality Act 2010” will apply only to biological women at birth.

Judge Patrick Hodge said that this law protects people from discrimination on the basis of their gender identity. However, inclusion of them in the category of women at birth would be inconsistent with the interpretation of law.

Impact on transgender rights

However, this decision will only keep transgender women out of the locations for women. They will not have the right to use facilities like women toilets, changing rooms, hospital wards, jails and counseling centers for misconduct victims. For this, they have to give special reasons.

Transgenders excluded from women’s games

Transgender women can also be excluded from women’s games. The impact of this decision will not be limited to Britain only. US President Donald Trump has also recognized only two sexes in the US: male and female. Transgender women are excluded from government, army and sports. This decision of Britain can give direction to discussion on trans rights in other countries like the United States.

Trans workers’ response

Trans Activist India Wilobi called this decision “derogatory”. He said, “It is a historical injustice to deny my female identity.”

On the other hand, ‘Harry Potter’ writer J.K. Rowling welcomed the decision and praised the groups fighting for women’s rights. But this decision is likely to have serious consequences. This is likely to create a big uproar in the LGBTQ community.
