In 2022, the ‘For Women Scotland’ group filed a petition in the Supreme Court after losing the case in the Scottish courts. A bench of five judges of the Supreme Court unanimously gave a decision. Judge Patrick Hodge said that this law protects people from discrimination on the basis of their gender identity. However, inclusion of them in the category of women at birth would be inconsistent with the interpretation of law.
