The breakup should not become a rape case.
A bench of Supreme Court Justices MM Sundresh and Rajesh Bindal said, “The end of love affair or breakup does not mean whether the case becomes a case of rape.” The way the values are changing in society now. We have to understand that a case of rape should not be made due to the breakdown of the relationship. It is noteworthy that the court, while hearing a person’s petition, applied to cancel the rape case.
According to the report, the woman had filed a rape case against the person who had got engaged but could not marry. The woman claimed that a false promise of marriage was made with her. In this case, senior advocate Geeta Luthra pleaded on behalf of the young man, while Madhavi Dewan argued on behalf of the woman. Hearing the case, the bench of the Supreme Court told the woman, “If you were so innocent, you do not come to us.” You were adults. It cannot be said that someone has fooled you by promising marriage. It should be said with full respect that morality and values have changed today. Especially among the younger generation. If we agree with you, the relationship between boys and girls in college will be punishable.
The bench of the Supreme Court said, ‘Suppose there is love between two college students. The girl retreats and the young man says that I will marry you next week. After this he does not do this again. Would it be considered a crime to do so? This is a traditional approach. In which all the expectations are fixed only on men.
Advocate Madhavi Dewan said, ‘Permission to have sex in this case is not a matter of independent consent. The issue here is that the girl felt that if she does not please her fiance, she would not marry her. Both were engaged. This must have been a normal relationship for the young man, but this was not the case with the woman.
Expressing disagreement with this argument, the Supreme Court bench said, “Tell me, should not just marry should be considered a crime of rape?” We cannot see this matter from just one perspective. We have no attachment to any one gender. I also have a daughter. If he were in this position, I would also see it from a wide perspective. Now tell me whether this matter has been made on such weak arguments? The complainant knew that the relationship could be over. Still he maintained a relationship. The court has set the next date for hearing on the youth’s application.
