New Delhi: The Supreme Court on Friday gave an important verdict and directed the government and administration not to take any strict action against 6 members of a Kashmiri family, especially like sending them to Pakistan. The court has clearly stated that until the documents related to the identity of the family are thoroughly investigated, they should not be sent to Pakistan nor should any other drastic steps be taken against them.
What is the whole matter?
According to media reports, the family is originally from Kashmir and his son works in Bengaluru. It is being told that after the terrorist attack in Pahalgam, the process of sending this family to Pakistan was started. (Significantly, the government has allegedly intensified the process of sending Pakistani citizens back).
Referred to ‘human aspect’
A bench of Justices Suryakant and Justice N. Kotishwar Singh, while hearing the case, said that “human aspect” is also connected to it, which cannot be ignored. The court has also exempted the family that if they are not satisfied with the results of the investigation of the documents, they can knock the door of the Jammu and Kashmir High Court.
What was the plea in the petition?
The entire case came to light after hearing the petition filed by Ahmed Tariq Butt and his 5 other family members. In the petition, the family claimed that he had a valid Indian documents, yet he was detained and taken to the Wagah border, so that he could be sent to Pakistan.
Referring to government notification
During the hearing, the Supreme Court also noted that after the Pahalgam attack, the central government issued a notification on 25 April. Under this notification (except for some exceptions), the visas of Pakistani citizens were canceled and they were directed to leave India within a fixed deadline. It seems that action against this family started on the basis of this notification, which has now been stopped by the Supreme Court.
