Mumbai – The Bombay High Court has said in a judgment that if couples with two disabled children want to adopt a third healthy child, then there is nothing wrong in this. The court made this remark on a petition filed by a couple from Mumbai and directed the concerned authority to reconsider their case within six weeks.
The High Court has canceled the decision taken by the Central Adoption Resource Authority (Kara) in 2023. Kara rejected the couple’s request to adopt a third child under the update 2022 adoption rules, saying that he already had two children.
The High Court said in its judgment that if the couple are looking for new hope and are optimistic about the ability to welcome an additional member in the family, then there is nothing wrong in this. The court said in the order, thus the desire to make life more meaningful can be fulfilled. The court said that the adoption rule 2022 has some provisions for the power to relax the rules, especially in such circumstances. The court said that legal provisions should not be interpreted in such a way that parents of two disabled children can be prevented from adopting the third healthy child.
