The municipal officials claimed that the case of this temple was going on in various courts for the last 20 years. The case reached City Civil Court, High Court and Supreme Court. But due to lack of documents, the court declared the location of this temple illegal. We have demolished this temple because there is no restriction on demolition. A senior official of the Building and Factory Department of the K-East ward of the municipality said that all the legal procedures were followed before and after the demolition of the temple.
In this regard, Anil Shah, a trustee of Derasar, told ‘Gujarat News’ that the work of demolishing the Derasar here was done with the connivance of the society and Manpa officials of the Kamli Wadi campus. This temple was built in 1935. According to the municipal rules, any structure made before 1061-62 is considered valid. There was only structure here. A temple was built in it. A temple, considered a symbol of the faith of more than 400 Jain devotees, has been demolished. But now we are again worshiping the idol of Prabhuji. We will take all legal steps for the reconstruction of the temple and will strongly demand action against those responsible.
Parag Alvani, MLA from Vileparala assembly constituency, said that I had requested the municipal officials before sabotage and went to court. Give them time. Give the trustees of the temple a chance to speak. But the municipality destroyed the temple without listening to anyone and declared the temple illegal as per the order of the court.
Trustee Anil Shah said that the society who came here has got a partial OC. The builder had asked to remove the structure of the temple after the construction of the society. However, the builder did not get OC as he did not remove the structure. Therefore, the society filed a case against the temple in court. In fact, there was a structure here and in 1998 we built a temple or deception inside that structure. The plot on which the temple was built in 2005. The municipality gave us a notice, claiming that it was reserved. Then our legal battle started. Our temple is illegal as per the order of City Civil, High Court and Supreme Court. But in the previous order of the Supreme Court, we were given 8 days time to submit all the documents in the lower court. And our process for this was also going on. Meanwhile, we were informed that the temple would be demolished on Wednesday. So we immediately went to the High Court. We were about to get relief, but at 9 am on Wednesday morning, the municipality demolished the temple under heavy police security. During this sabotage, there was chaos due to opposition from the devotees. The police also forcefully lathi -charged. Trustee Anil Shah alleged that the reason for the demolition of this temple is the connivance of the Society and Municipal Corporation officials.
Meanwhile, Lalit Gandhi, National President of the All India Jain Minority Federation, has opposed the demolition of 1008 Parshwanath Digambar Jain Derasar in Vilepara by the municipality. In this regard, he has written a letter to the Chief Minister of the state Devendra Fadnavis demanding immediate action and reconstruction of the temple against the municipal authorities.
