Thane News: Motor Accident Claims Tribunal Awards ₹10.25 Lakh To Woman Injured In 2018 Bus Accident | Pinterest, Representational Image

Mumbai: The Motor Accident Claims Tribunal in Thane district of Maharashtra has granted ₹10.25 lakh in compensation to a 45-year-old woman who suffered serious injuries in a bus accident in 2018.

MACT member S N Shah found the bus owner, Ameya Travels, and its insurance provider, Bajaj Allianz General Insurance Co. Ltd., responsible for paying the damages. An order copy dated March 18 was provided on Saturday.

The claimant’s counsel, advocate Baldev B Rajput, notified the tribunal that the incident happened when a negligently driven bus collided with the gate of a building on Pedder Road in Mumbai during the night of January 1, 2018.

The claimant, Amee Dharmendra Bhuta, returning from a New Year party with friends, sustained multiple fractures and various serious injuries.

The court determined that the bus driver’s carelessness caused the accident. The authorities had also filed a criminal case against the driver.

Advocate Rajput further stated that the petitioner was 45 years old when the accident occurred and was working independently. Her monthly earnings were ₹25,000, and she sought ₹26.95 lakh in compensation under different categories from both opponents.

The tribunal observed that the woman experienced a 35 percent permanent partial disability as a result of the accident.

The tribunal granted compensation for several items, such as anticipated income loss, potential earnings, medical costs, specific dietary needs and transport, pain and suffering, as well as the loss of comforts and enjoyment of life.

The insurance firm was instructed to pay the compensation sum, plus 8 percent annual interest from the filing date of the petition, within one month.

The tribunal also permitted the insurance company to reclaim the awarded sum from the bus owner. It ordered that part of the awarded sum be given to the injured party and the remaining amount placed in a fixed deposit.
