The Judicial Magistrate First Class (JMFC) court in Belapur delivered the first conviction under the Bharatiya Nyaya Sanhita, 2023. The court sentenced Shekhar Sukhdev Hatkar to one month and 10 days of simple imprisonment for committing gold theft, punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023.
The incident dates back to December 10, 2024, when Hatkar was arrested by Nerul Police for robbing gold ornaments and a wallet from the complainant. Following his arrest, Hatkar was remanded to judicial custody. During court proceedings held via video conferencing, the accused admitted to the crime and voluntarily pleaded guilty.
While passing the sentence, the court stated: “The accused, Shekhar Sukhdev Hatkar, voluntarily pleaded guilty to the charges during video conferencing. Considering his plea, I am satisfied that it is voluntarily made and accept the same. The accused submitted that he is repenting for his actions and has family responsibilities. Taking into account the facts, circumstances of the case, the nature of the offence, and the fact that the accused has been in jail since his arrest, I take a lenient view while passing the sentence.”
Hatkar was sentenced to simple imprisonment of one month and 10 days. The court took into consideration his guilty plea, remorse, and the time already spent in custody.
