Bhopal (Madhya Pradesh): The district and sessions court here on Tuesday awarded triple capital punishment to a man in a case of rape and murder of a five-year-old girl in a Shahjahanabad multistorey building in September 2024. ADJ Kumidini Patel passed the order.
The mother and sister of the man were found guilty of hiding evidence and awarded two-year jail terms. The capital punishment to the convict Atul Bhalse was awarded each under Sections 103, 66 and 64(1) of BNS and life imprisonment under various sections of Protection of Children from Sexual Offences (POCSO) Act.
Compensation of Rs 4 lakh provided to victim’s family
Besides, Rs 4 lakh were also provided to the victim’s family. However, the girl’s family demanded at least 10 years’ jail term for the two women who were co-accused. The victim’s mother and grandmother told the court that co-accused Chanchal and Basanti also had criminal records and played a major role in the rape and murder of child, so they should be given at least 10 years’ imprisonment.
ADJ Kumudini Patel said, “Capital punishment has been given to Atul who deserves it for his crime. So far as the role of his mother and sister is concerned, they only hid the evidence. So, two years’ jail term has been awarded and 10 years’ imprisonment cannot be granted.”
ADJ also asked Basanti and Chanchal about their criminal records in connection with the allegation made by the girl’s mother and grandmother after the judgment, but they denied having any criminal record.
The case
On September 24, 2024, a five- year-old girl went missing from a Shahjahanabad multistorey building. Her body was found in a closed flat in the same building. She girl was strangled to death after rape. Atul Bhalse, his sister Chanchal Bhalse and mother Basanti Bhalse who lived in the flat were arrested in this case.
The Bhalse family’s flat was right opposite the girl’s grandmother’s flat. Atul strangled the girl to death after rape and hid her body in the water tank. His sister Chanchal Bhalse and mother Basanti Bhalse had tried to hide the incident, so the police made them co-accused. Ironically, the accused family had kept on searching for the girl along with her kin.
