Mumbai: A sessions court has sentenced a 40-year-old man, resident of Malad, to life in prison for murdering his 57-year-old neighbour over a disputed property on June 14, 2020. The sentencing took place on Thursday. Nonetheless, three other individuals charged in connection with the murder were acquitted due to insufficient evidence, with the court determining that only the defendant, Bada Anand, carried out the crime.
The case was initiated by Nadar’s brother, the late Pandi Nadar, who claimed that the men pursued Sunderraj, with one of them threatening to kill him over his refusal to relinquish a piece of land. According to the complaint, the men fled after attacking Sunderraj, and Pandi discovered his brother injured with wounds on his head and face.
Since Pandi Nadar died before the case was resolved, the prosecution could not rely on his testimony to support the contents of the FIR and instead depended on the statements of the investigating officers.
In the ruling delivered on April 17, additional sessions judge Nandkishor More stated, “Four individuals were observed to have been involved in the altercation. The prosecution failed to demonstrate that the other three defendants were part of an unlawful assembly or committed the crime. The evidence presented confirms that Bada Anand is solely responsible, supported by electronic evidence (CCTV footage), circumstantial evidence, and medical evidence,” according to report by Hindustan Times.
