Thane: The Thane Motor Accident Claims Tribunal (MACT) has awarded a compensation of Rs 3,96,078 in to Jayant Janardhan Joshi (60), a resident of Thane, for injuries sustained in a road accident in 2016. The tribunal found the driver of a pickup van, owned by Kishan Namman Yadav from Vasai, guilty of negligent driving, which led to the accident.

According to Joshi’s petition, on June 23, 2016, at around 1:45 p.m., he was waiting at the Vijay Garden bus stop when a pickup van reversed negligently without honking, signaling, or assistance from a cleaner. The vehicle hit him, causing him to fall and sustain severe injuries. Joshi underwent surgery on his right leg.

A criminal case was registered against the van’s driver under Sections 279, 337, and 338 of the Indian Penal Code and Sections 134(A) and (B) of the Motor Vehicles Act, 1988.

The tribunal in its orders maintained that Joshi, was a retired professional holding B.Com, LL.B., and Company Secretary degrees, had started a consultancy for small-scale companies specializing in HR and finance. He claimed he was earning Rs 20,000 to Rs 30,000 per month before the accident. However, due to the injuries and ongoing medical treatment, his ability to work was severely impacted.

Since the vehicle owner did not contest the case, the tribunal proceeded ex-parte and ruled in Joshi’s favor. It awarded him compensation under several heads like Rs 1.5 lakhs for loss of income, Rs 1,56,078 for hospital and medical expenses, Rs 30,000 towards his special diet and conveyance, Rs 30,000 towards the complainant’s pain and suffering and Rs 30,000 towards the loss of amenities and enjoyment of life.
