Mumbai: Stand-up comedian Kunal Kamra is now slowly getting entangled in the legal process as more FIRs have been filed against him after he received interim bail in the first case.
On March 28, the Khar police registered three more FIRs against him based on complaints from Shiv Sena (Shinde) office bearers. Legal experts said that the Mumbai police can arrest him or issue a notice to him in these three cases, as the Madras High Court’s interim bail order does not apply to the fresh cases.
Statement Of Lawyer Sayaji Nangre
Lawyer Sayaji Nangre stated, “The Madras High Court granted him interim bail. Now he has two options: He can move to the Mumbai Sessions Court for regular anticipatory bail within a week, and he can file a bail application for the three fresh FIRs as well. He has received transit anticipatory bail, which means the Mumbai police cannot arrest him if he arrives in Mumbai before April 7 in the first case. However, the police can arrest him in connection with the three FIRs filed on March 28. Now, he can first approach the Sessions Court for anticipatory bail. If the Sessions Court refuses his anticipatory bail, he can move to the High Court, and if the High Court rejects his petition, he can then approach the Supreme Court.”
Statement Of Lawyer Abha Singh
Lawyer Abha Singh stated, “Finally, if the multiple FIRs are registered in respect of the same offence, Kamra can approach the Supreme Court and request the clubbing of FIR by invoking the Supreme Court case law of Babubhai vs State of Gujarat. As per procedure, for each separate FIR, Kamra will have to apply for fresh anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). However, if the multiple FIRs stem from the same ‘incident’ of offence, then when he subsequently applies for anticipatory bail, his claim to anticipatory bail will be strengthened, and he can cite the earlier interim ABA order as a precedent.”
About The Case
On March 23, Kamra uploaded his Naya Bharat special show on social media, featuring remarks about Prime Minister Narendra Modi, Union Finance Minister Nirmala Sitharaman, industrialist Mukesh Ambani, his son Anant Ambani, Anand Mahindra, and Maharashtra Deputy Chief Minister Eknath Shinde.
The next day, Mumbai’s Khar police registered an FIR against Kamra for defamation following a complaint by Shiv Sena (Shinde faction) MLA Murji Patel. Kamra approached the Madras High Court, which granted him interim bail until April 7.
