Kalyan Magistrate Court acquits four accused in a 2014 assault case due to insufficient evidence | Representational Image

Mumbai: The Kalyan Magistrate Court has acquitted four individuals accused in a 2014 assault case due to a lack of evidence. The case, registered was filed by the Maharashtra government against the accused, alleging physical assault and issuing threats against the complainant.

The incident occurred on November 19, 2014, when complainant Subhash Salgude objected to a poultry truck dumping dead chickens near his residence in Ghaikarpada, Kalyan. The complainant allegedly confronted the truck driver, which led to a dispute.

Following this, the accused individuals—Nitesh Dattu Gaikar (36), Anil Dattu Gaikar (41), Raja alias Sudhakar Bhalerao (26), and Harishchandra Vishnu Gaikar (45)—allegedly assaulted the complainant with punches and kicks, resulting in injuries to his abdomen, ribs, chest, and right hand.

Salgude later lodged a complaint at the Bazarpeth Police Station. During the trial, the prosecution presented two key witnesses: Pradip Shankar Mane (panch witness) and Suresh Bhamrao Salgude (brother of the complainant).

However, both witnesses failed to support the prosecution’s allegations. Mane testified that he was called to the police station but was not present at the alleged crime scene, while Suresh denied witnessing any assault. Additionally, the complainant, Subhash Salgude, had passed away in 2020, and the investigating officer failed to appear in court despite multiple summonses.

Considering the lack of credible evidence, the First Class Judicial Magistrate, Smt. S.A. Pathan, ruled that the charges against the accused could not be proven beyond reasonable doubt. As a result, all four accused were acquitted of the charges.
