Not a crime: Supreme Court: The Supreme Court, while hearing a case recently, said that it is not a crime to call someone Mian-Tiya or Pakistani. The court also said that although it could be wrong, it is not a crime under Section 298 of the Indian Penal Code (IPC) to hurt religious sentiments. Hurting religious sentiments is not a crime under Section 298 of the IPC.

 

The Supreme Court has acquitted the accused in the ‘Hari Nandan Singh vs Rajasthan’ case. The court acquitted the accused from crime under Section 298 of the Indian Penal Code (with the intention of deliberately uttering the word with the intention of hurting religious sentiments).

What was the whole matter?

The Supreme Court said that the appellant was accused of hurting the person by calling the person ‘Mian-Tian’ and ‘Pakistani’. A bench of Justice BV Nagaratna and Justice Satish Chandra Sharma gave the verdict on 11 February. The accused was accused of calling a government employee ‘Pakistani’ while performing government duty.
