The Supreme Court on Wednesday (April 16) heard the petitions challenging the constitutional validity of the Waqf Amendment Act, 2025. In these petitions, several sections of the Waqf Amendment Act 2025 have been declared unconstitutional and demanded to be canceled. The next hearing will be held on May 5, as the next day the Supreme Court issued an interim order on the Waqf Act.

 

Next hearing on 5 May

The Central Government will have to respond within 7 days on the interim order of the Supreme Court on the Waqf Act. Following the interim order of the court, government work to notify the registered properties has been stopped and new appointments have also been stopped. Until the central government replies, there will be no change in the status of Waqf property. The property declared by the court will not be notified non -notified. There will be no new appointments in the Waqf Board and the Central Waqf Council. Further hearing regarding the Waqf Act will now be held in May next year.

Hearing in Supreme Court on Waqf Bill

After the Waqf Bill was passed in the Rajya Sabha and Lok Sabha, the Congress party challenged this law in the Supreme Court. The Supreme Court was heard on the Waqf Act for the second consecutive day on Thursday. The hearing of the case started in the court at 2 pm. Earlier, there was a hearing in the court on Wednesday. During this time the Muslim side and the central government presented their respective arguments. The central government said during the hearing on Wednesday that their arguments should be heard before issuing the interim order. The bench of Chief Justice Sanjeev Khanna, Justice Sanjay Kumar and Justice KV Vishwanathan is hearing these petitions. A bench of three judges has proposed to ban three provisions of the Waqf Act. An interim order can also be issued regarding the powers of the collector. The court is also likely to issue an interim order regarding the inclusion of non-Muslims in the Waqf Board.

Petition in Supreme Court against Waqf Act

Let us tell you that 73 petitions have been filed in the Supreme Court against the new Waqf Act. Of these, the Supreme Court has listed a total of 10 petitions related to Waqf for hearing. The validity of the Waqf Act has been challenged in the court. In these petitions, several sections of the Waqf Amendment Act 2025 have been declared unconstitutional and demanded to be canceled. The petitions claimed that the Waqf properties would be managed unusually under the amended law and the law violates the fundamental rights of Muslims. The Supreme Court today issued an interim order on the Waqf Act and the next hearing will be held on 5 May.
