Important Decision of Bombay High Court on Property Dispute: Property gifted by father is not ancestral

Recently, a case reached the Bombay High Court, in which there was a dispute over property rights between the brother and sister after the death of the doctor. In this dispute, the court has clarified that the property gifted by the father during his lifetime will not be considered ancestral property.

What was the matter: After the death of a Mumbai doctor, a dispute arose between his son and two daughters over his property. The sisters claimed that the flat present in Mumbai was bought from the family shared funds and loans from parents, so they deserves to get a share of it. He alleged that his brother secretly got these flats secretly got them in his name and sold without giving information.

The sisters, through their lawyer, demanded from the court that one -third of this property should be given to them as family property.

Brother’s argument: The brother told in the court that the flats were his father’s personal acquired property, which the father gifted him during his lifetime. The sisters did not challenge this gift then. Bhai said that by selling property, he bought other properties, one of which he has gifted his son, which is now the center of controversy.

High Court verdict: The Bombay High Court, while giving an important verdict in this case, said that the property acquired by the father to the son himself cannot be considered as family or ancestral property. The court partially accepted the interim petition of the sisters and ordered that the brothers cannot sell or transfer the disputed flat without the permission of the court.

The court also said that there are no two important things in favor of the sisters. First, he had already got a share while selling family property, and second, the family tried to compromise in the past to resolve the dispute. Therefore, the court ordered to maintain the status quo on the flat named after the brother’s son.
