  3. In case of divorce or separation: If the husband and wife get divorced or they start living separately, the wife cannot claim a stake in her husband’s property. According to the law, in such a situation, the wife has the right to get only the maintenance from her husband, so that she can live her life.

Rights in in -laws’ ancestral property:

  • Meaning of ancestral property: This is the property that is coming from generation to generation in the family (such as grandfather’s land or house).

  • When?: According to the Hindu Succession Act (Section 8), as long as the woman’s husband or mother-in-law is alive, she has no direct right over the in-laws’ ancestral property.

  • After husband’s death: Yes, if the husband dies, the wife gets equal rights to her husband’s share from that ancestral property. The Supreme Court also further clarified the rights of women in such a common assets in an important decision of 1978 (Gurupad Khandappa Magadam vs Hirabai Khandappa Magadam).
