Gwalior Man Orders Veg Burger, Receives Non Veg: Consumer Forum Orders Compensation | FPJ
Gwalior (Madhya Pradesh): A man from Gwalior was stunned to see a non-veg burger, when he ordered a veg! He had placed the order via food delivery app Zomato.
The customer identified as Ashish Sharma. Hailing from the Brahmin community, Sharma took to consumer forum, stating that the mix-up hurt his religious sentiments. He shared the order details and bill receipt, which clearly mentioned his order of Veg-Chilly Loaded Burger.
He also launched a complaint on Zomato for the same at first.
Zomato Compensated
The platform immediately refunded ₹175 and further compensated the man with ₹500. However a compensation didn’t satisfy the complainant as he felt that this was major functional lapse and he further escalated the matter to consumer forum.
After reviewing the case, the consumer forum ruled in favor of the complainant and held both Zomato and Burger Buddy responsible for the mistake. The forum ordered them to pay ₹5,000 each as compensation and an additional ₹1,000 each to cover legal expenses.
Detailed Case
According to advocate Aditya Sharma, the complainant, Ashish Sharma, a resident of Kumharpura, had ordered a Veg Chilli Loaded Burger via Zomato. The food was delivered within 20 minutes, but upon opening the package, he discovered a non-veg burger instead.
When Sharma raised the issue with Zomato, the company initially refunded the amount and later added a ₹500 bonus. However, believing that monetary compensation was not enough for such a mistake, he took the matter to the consumer forum.
Zomato and Burger Buddy’s Defense
In defense, Zomato argued that it is merely an online platform and should not be held accountable for service errors made by the restaurant. On the other hand, Burger Buddy claimed that the order was delivered correctly and suggested that the complainant might have changed it himself.
