Mumbai – The Bombay High Court has ordered the state government to file an FIR against five police personnel responsible for interrogation of Akshay Shinde, accused in the Badlapur sexual harassment case. The CID has been asked to hand over the investigation documents to the SIT within two weeks.

Justice. Revathi Mohite Dhere and Nya. A bench of Justice Neela Gokhale has directed the Joint Commissioner (Crime) of the Crime Branch to constitute a Special Investigation Team (SIT) to investigate the case.

The court criticized the government for refusing to register an FIR in the case and said that such an act questions the credibility of the government and reduces the trust of the people in the justice system.

The court said, “After reading the magistrate’s report, we agree that a thorough investigation into the matter is necessary, as Shinde died due to the bullet fired by the police.”

It is important to see that justice is not only being given, but also being given. The court said, “We hope and confident that the SIT will expose the conspiracy.”

When a case of prima facie crime comes to light, the police should investigate according to the law and it is the duty of the police to bring the truth of the case to be revealed.

The Joint Commissioner of Police has been instructed to set up an SIT and register an FIR under the supervision of the Deputy Commissioner of Police. The court has also refused to adjourn the order.

Shinde, accused of sexual harassment of two minor girls at a school in Badlapur in Thane district, was killed in a police firing on 23 September 2024. The incident occurred when he was being taken to Kalyan from Taloja Jail. The police claimed that he had fired in self -defense.

The magistrate’s investigation report indicated the involvement of five police officers. Shinde’s parents claim that the encounter was fake, it was found to be true. Senior Inspector of Thane Crime Branch Sanjay Shinde, Assistant Police Inspector Nilesh More, Head Constable Abhijeet More and Harish Tawde as well as police driver Satish Khatal have also been involved in this.

The state government said that the CID is conducting an independent investigation and the government has constituted an inquiry commission under the chairmanship of the retired Chief Justice of the Allahabad High Court. The report will be submitted to the court concerned after the CID investigation is completed.

Despite the request of Shinde’s parents not to extend the case, the court has continued the case in the interest of justice. The court said that the complaints of poor people cannot be ignored. The case could have been closed, but failure by the state to fulfill its obligations could not be ignored. The court said that in the interest of justice, the criminal law can be implemented against anyone including the police.
