Mumbai: The BMC’s D-Ward team, led by sub-engineer Dhiraj Karande, has registered an FIR at Malabar Hill Police Station against developers Fayazuddin Sheikh and Wasim Ishaq Sheikh of Fairdeal Construction, along with architect Prakash Ramanlal Dharia, for unauthorized construction at Ocean 360 on Banganga Road, Malabar Hill. The action was taken under Section 53(7) of the Maharashtra Regional and Town Planning (MRTP) Act, 1966, following a complaint filed by Uvesh Potiawala, represented by SSL Advocates, on January 6, 2022.
According to the police, an inspection by the BMC team revealed significant deviations from the approved plans, which were sanctioned on January 2, 2019, under approval number EEBP 4944/D/A by the Municipal Corporation of Greater Mumbai (MCGM). Key violations included unauthorized brickwork in podium lift lobby areas designated for parking and illegal window extensions of up to 1.2 meters in various flats of Wing B. Additionally, duplex flats 1701 and 1702, located on the 17th and 18th floors, encroached upon elevation treatment space.
A notice under Section 53(1) of the MRTP Act was issued on March 8, 2022, demanding compliance. However, a High Court stay delayed any action until February 28, 2024. A subsequent inspection on November 4, 2024, confirmed that no rectifications had been made, leading to the filing of the FIR.
The developers and the architect are accused of proceeding with unauthorized construction without obtaining the requisite approvals. Further investigations are underway.
