Mumbai-A special CBI court has sent the CBI application to the magistrate court to issue a non-bailable warrant against fugitive businessman Mehul Choksi and said that considering this application does not come under the jurisdiction of this court. The CBI has filed this application in the case of fraud of Rs 55 crore associated with Canara Bank and Bank of Maharashtra.

Choksi was arrested on 12 April in Belgium in the Punjab National Bank fraud case. This action was taken after the extradition request of the Indian Investigation Agency.

Special Judge Desai cited the Supreme Court’s verdict stating that the Special CBI court could hear the case under the Anti -Corruption Act, but it should include a charge of involvement of a government employee.

The judge said that there is no mention of crime under the Prevention of Corruption Act anywhere in the entire charge sheet.

A charge sheet has been filed against private persons for crimes under the Indian Penal Code in this case. Therefore, this crime can be heard in the magistrate’s court, the special judge has no right to issue an order, hear or settle the case.

The entire CBI case, including the application for non-bailable warrant, was transferred to the Additional Metropolitan Magistrate for final disposal.

According to the details of the case, Canara Bank and Bank of Maharashtra received Rs. Under the Consortium Agreement, basal jewelery will be provided Rs 100 crore as capital facility respectively. 30 crores and Rs. Twenty -five crore rupees were sanctioned. This loan was taken for the production and sale of gold and diamond jewelery, but the company did not make any commercial transactions through an account to hide the misuse of funds. The CBI has alleged that the loan was not paid and the consortium suffered a loss of Rs 55.27 crore.
