The Bombay High Court has granted bail to his mother and his partner arrested on charges of beating and attacking a seven -year -old child. The court said that no mother would beat her child and the matter seems to be related to the matrimonial dispute of the parents, due to which the child became a goat of sacrifice.

Child’s condition and mother’s role
The single bench of Justice Milind Jadhav, citing the child’s medical report, said that the child is suffering from diseases like epilepsy, malnutrition and anemia. The court said that it is clear from medical documents that the accused mother had tried to take care of the child.
The woman was arrested in October 2023 and was in custody since then. Giving bail, the High Court said that the police did not follow the mandatory provisions of the Criminal Procedure Code during the arrest.
Father’s allegations and police investigation
An FIR was lodged at the Daisar police station in Mumbai on the complaint of the child’s biological father. The father alleged that his separate wife and his partner beat up the child several times and even tried to kill him.
The complaint also alleged that the woman’s partner sexually attacked the child. However, the High Court said that prima facie these allegations seem incredible.
Court verdict
The High Court granted bail to the woman on a personal bond of ₹ 15,000 and said that the allegations against the mother do not seem acceptable in normal circumstances.
According to the complaint, after the separation of parents in 2019, the child was living with his father in Ratnagiri, but in 2023 the mother forcibly brought him to Mumbai.
The court questioned the functioning of the police in this case and said that the rules were not properly followed in the arrest of the accused.
