Mumbai – The High Court has granted an emergency bail to the late underworld don Karim Lala’s grandson Parvez alias Chinku Pathan and alleged drug smuggler Arif Bhujwala on an emergency ground on medical grounds. Bhujwala was arrested in 2021 after a cache of drugs was recovered from his hideout in Malegaon.

Bhujwala was granted bail due to the need for immediate medical treatment due to a serious heart problem. The case was heard under medical emergency and the application was postponed till 28 February.

An affidavit was filed opposing the application, but the representative of the Central Government did not appear despite prior information to appear. Hence this order was given in his absence. The Narcotics Control Bureau (NCB) and the Center opposed the bail application and said that many such applications would come. It was argued that there is a need for further investigation into Bhujwala’s health. No documents were submitted in support of the claim that the accused had repeatedly denied hospitalization.

According to medical records, Bhujwala was asked several times to be admitted to JJ Hospital for treatment. Recently, in February 2025, he was advised to be admitted to ICCU, but Bhujwala refused to be admitted. The report indicates serious illness. Even if we accept the government’s claim, the court said that the condition of the accused is critical.

The court dismissed the Center’s plea to make a direct statement without considering the individual case. The Center had said that if the petition is accepted in this case, then such irresponsible petitions would be flooded. Keeping in mind the medical condition of Bhujwala, the court went beyond the strict bail provisions of the NDPS Act and used his discretion to bail him.

Bhujwala was arrested by NCB in January 2021 on charges of making and selling drugs. 2.9 grams of heroin and 52.2 grams MDMA were seized from his house. During raids on four other flats, commercial amounts of drugs were seized.
