Jaipur, 29 November (Hindustan Reporter). The Rajasthan High Court has rejected the appeal filed in 1992 in the case related to the attempt to rape a five-year-old girl in February 1985 and has asked the petitioner accused to surrender to undergo the remaining sentence. The single bench of Justice Anup Kumar Dhand gave this order on the petition of Shiv Prakash. The accused was 20 years old at the time of the incident. Now at the age of 59, the decision has come.
The court said in its order that for an attempt to be made there must first be an intention to commit the relevant offence. After that such act must be done which is necessary to commit the crime. At the same time, such an act must be close to the result of the crime. In the case, the accused did whatever was necessary to rape the victim. In such a situation, it is a clear case of attempt to rape. In the petition, advocate Pranav Pareek said that the victim’s father had registered a case of attempt to rape at Baran police station on February 7, 1985. In which the ADJ Court had sentenced the petitioner to five years’ imprisonment on December 18, 1991. Apart from the victim, there was no independent witness in the case. Apart from this, no injuries were found on the victim in the medical examination. On behalf of the government, advocate Manvendra Singh said that an attempt to rape has been proved in the FSL investigation. After hearing both the sides, the court rejected the petition.
