Mumbai-The Nagpur bench of the Bombay High Court has ruled that an adult unmarried daughter who is unable to maintain herself under the Hindu adoption and maintenance Act has the right to demand maintenance from her father.

On 24 January 2024, the Akola Family Court sanctioned an amount of five thousand per month for the adult unmarried daughter and the father filed an application in the High Court. The father claimed that his adult daughter is not entitled to maintenance under Section 125 of the Penal Code.

The High Court, considering the claim, clarified that the daughter has authority under the Hindu Adoption and Maintenance Act. The High Court said that according to Section 125 of the Criminal Penal Code, an adult unmarried daughter is eligible to maintain maintenance when she has a physical or mental problem. The court said that this law does not apply to ordinary adult daughters, but under Section 20 of the Hindu Adoption Act, an adult unmarried daughter who is unable to maintain herself, has the right to maintain maintenance from her father Is.

According to the details of the case, the daughter’s parents are living separately due to family dispute. The daughter is studying law in Mumbai by staying with her mother. He did not have the means of production, so he applied to the family court and demanded maintenance from his father.
