America canceled F-1 visa, four Asian students including an Indian student opened front against Trump administration

Four Asian students, including an Indian student studying in a public university in Michigan, USA, have filed a case against the Trump administration, alleging that their student visa (F-1) was illegally canceled. These students have started a legal battle against the threat of potential exile from the United States.

Who filed the case?

Chinmay Devre of India, Jiangyun Bu and Qi Yang of China and Yogesh Joshi of Nepal on Friday filed a case against the US Home Safety Department (DHS) and immigration officials. All four students allege that their student immigration status was illegally canceled without any sufficient notice or clarification in the student and exchange visitor information system (SEVIS). SEVIS is a database that collects information about non-resident students and exchange visitors in the United States.

Visa was suddenly canceled, no reason was told

The American Civil Liberty Union of Michigan (ACLU), which represents the students, said that it has filed a case in the federal court on behalf of these students demanding emergency prohibition. ACLU says that the Trump administration has illegally canceled the F-1 visa status of these students without any proper reason or prior notice. The court requested the court to restore the status of these students so that they can complete their studies and avoid the risk of custody or exile.

‘Neither a crime nor found guilty, then why action?’

The complaint filed in the court stated, “None of these students have been accused of any crime in the US, nor have they been convicted. No one has violated the immigration laws, nor has they been active in any political protests in the campus.”

The complaint includes DHS Secretary Christie Nom, Acting ICE Director Todd Leone and ICE Detroit Field Office Director Robert Linch. Similar cases have also been filed in other American states including New Hampshire, Indiana and California.

What is F-1 visa?

F-1 visa allows foreign students to enter and live in the United States for full-time study in recognized American colleges, universities, other educational institutions or language training programs.

Previous case

It is noteworthy that in a similar case, an American judge first temporarily stopped the Trump administration from deportation of 21 -year -old Indian graduate student Krishna Lal Isardasani, whose student visa was canceled. Krish is going to graduate in next May.
