The Lucknow bench of the Allahabad High Court has directed the Union Home Ministry to take a decision within four weeks in the alleged dual citizenship of Congress MP and Leader of Opposition in Lok Sabha.

The ministry had sought 8 weeks of time on the issue, but the court made it clear that a decision should be taken within four weeks in the case.

The dispute has been in discussion for many years, alleging that Rahul Gandhi also has a UK citizenship. A PIL (PIL) has been filed on this issue, on which hearing is going on in the High Court.

High court sought reply from Center, government failed in last hearing

Earlier, on 19 December 2023, the High Court directed the Central Government to present its reply on the case by 24 March 2024. However, the central government could not file a reply within this deadline.

This petition was received by social activist S.K. Vignesh Shishir has filed. According to the petitioner, Rahul Gandhi is also a UK citizen besides India, a violation of Article 84 (A) of the Constitution. If this charge is proved, Rahul Gandhi’s Lok Sabha membership may be canceled.

1. Rahul Gandhi’s alleged British citizenship

The petitioner has alleged that Rahul Gandhi also has British citizenship, and has maintained activeness in Indian politics by hiding it.

2. Cited the documents of the British Government

The petition cited a confidential mail of the British government for 2022, claiming that Rahul Gandhi had received Britain’s citizenship.

3. Demand to abolish Indian citizenship

The petition has demanded Rahul Gandhi’s cancellation of Indian citizenship under Section 9 (2) of the Indian Citizenship Act, 1955.

4. Question on the ability to contest elections

The petitioner says that Rahul Gandhi hid his British citizenship information while contesting from Rae Bareli Lok Sabha seat. Therefore, their election should also be canceled.

5. No action despite complaints from competent authorities

The petitioner claimed that the matter was earlier raised in front of several government agencies and competent officials, but when no action was taken, they decided to file a PIL.
