IndiGo Sues Mahindra
Barely a few days after its big reveal, the Mahindra BE 6e, the brand-new electric vehicle, has found trouble. India’s largest airline, Interglobe Aviation’s IndiGo, has sued the car manufacturing company. The airline has taken Mahindra to court over its use of ‘6E’ or ‘6e’, the name of one of its newly revealed cars.
This name or combination is also the identifying component of the airline. Therefore, it is a key portion of the airline’s branding, as it uses the same combination across the board, from its websites to its social media handles.
Mahindra group revealed its new set of electric cars, the XEV 9e and BE 6e in November.
IndiGo Registered 6E In 2015
This case was filed in the Delhi High Court, accusing the Mumbai-based car company of infringing trademark.
The low cost airline procured registration for the word mark ‘6E Link’ under classes 9, 35, 39 and 16 in 2015.
As according to Bar and Bench, the case came up before Justice Amit Bansal on Tuesday. The case’s hearing will now be conducted on December 9, as Justice Bansal rescued himself from hearing in case.
Senior Advocate Sandeep Sethi appeared for IndiGo.
It is also being reported that Mahindra tried to communicate with Airline to reach a conclusion.
Mahindra is yet to make an official statement through any of its channels.
In India the Trademark Act of 1999 looks after issues of trademark infringement.
In all, there are 45 classes of trademark, in which 34 classes are for goods and 11 classes of services.
