The tension between India and Pakistan is at its peak. Both countries are standing on the verge of war. However, the biggest question and confusion is whether there is a war between the two countries? How is war declared? When India fought its first war, did anyone formally announce it?

 

Pakistan had tried unsuccessfully to attack several Indian military locations including Jammu, Pathankot and Udhampur with drones and missiles, which was thwarted by the Indian Army. Who declares war in India?

There is no clear or formal provision for “declaration of war” in the Constitution of India, but there are rules for the declaration of national emergency. This power is with the President, but he only serves on the advice of the Prime Minister and the Council of Ministers. A national emergency can be imposed under Article 352 of the Constitution when there is an external attack on the country or a situation of war. The President makes this announcement on the written recommendation of the Council of Ministers.

War declaration process

  • The Union Cabinet is assessing the status under the chairmanship of the Prime Minister.
  • In this, Ministry of Defense, Ministry of External Affairs, National Security Council and military and intelligence agencies give their reports and suggestions.
  • The final decision is taken by the Council of Ministers headed by the Prime Minister.
  • The President then formally implements that decision, such as declaration of national emergency.
  • This decision is presented to both the Lok Sabha and the Rajya Sabha for approval.
