Supreme Court: Supreme Court has given important decision on property ownership, not getting ownership from filing and dismissal

The Supreme Court has recently given an important verdict, which explains the confusion of the people over the property ownership. According to the court, no person gets ownership of property by just registering the name in the revenue records (filing-dismissal or mutation) of the land.

Supreme Court decision:

The bench of the Supreme Court, which included Justice MR Shah and Justice Anirudh Bose, clarified that the purpose of the mutation or filing process is mainly financial, that is, it only determines the responsibility of payment of land revenue. Being a name in this record does not give a person legally ownership rights.

The court emphasized that the ownership can only be determined by the competent civil court. The information recorded in the revenue record does not prove the legal right on the property.

Practicality of mutation process:

According to Group CFO of Housing.com, mutation is an administrative process that the property has been transferred from one person to another. However, this does not give anyone ownership rights. This process only helps to update the administrative records and entrust the responsibility of tax collection to the concerned authorities.

At the same time, the court suggested that it is necessary to update the mutation record in case of property dispute, but it is not a proof of ownership.

What to do in property dispute:

The Supreme Court also suggested that it is important to preserve the required documents and documents related to the property to avoid the dispute. If property disputes arise, the person should immediately complete the mutation process so that there is no confusion during any legal action. However, the final decision will be taken by the Civil Court itself.

This decision can be a relief for those whose names have not been recorded immediately in the mutation record for some reason.
