The Supreme Court said that systemic discrimination against disabled persons should be abolished and in 2024, Divyang candidates who have passed MBBS entrance examination have been ordered to allocate seats in AIIMS.
There is a provision for proper housing in the Divyangjan Rights Act, 2016. A bench of Justice Vikram Nath and Justice Sandeep Mehta said that this system is not a charity or a favor but a fundamental right.
It is noteworthy that this application was filed by Kabir Pahadia. The five fingers of this candidate are partially developed and is unable to move. This candidate was refused to admit MBBS due to his disability.
Earlier, on 2 April, the Supreme Court ordered a new medical examination of the candidate by the Medical Board constituted by the All India Institute of Medical Sciences.
The medical board concluded that Pahadia displayed functional adaptation using its existing fingers during various tasks.
Pahadia challenged the Delhi High Court order to dismiss its petition in the Supreme Court. The Supreme Court said that refusal to give admission to MBBS graduate course to the petitioner is an illegal, arbitrariness and violation of the fundamental rights of the Constitution.
