US officials have requested the Government of India to cooperate in giving notice to the Adani Group President Gautam Adani and his nephew Sagar Adani on the allegations of security fraud and bribery in the US.
In this regard, a status report has been filed in the New York court by the US Securities Exchange Commission (SEC) and the Department of Justice (DOJ) where the case is being heard. In this report, both these organizations have said that they are still waiting for the response of the Government of India in this regard.
The SEC sought help from the Law and Justice Department of India in February to send a notice of legal trial (a notice in which a case is reported against them) and a request for exemption from the service of summons (a proposal that requested a voluntary request to accept legal documents). This assistance was sought by the SEC from the Government of India under the Hague Service Convention, which provides for legal cooperation between the two countries.
However, the Department of Law and Justice, Government of India has accepted the SEC about receiving such a proposal and has instructed the concerned authorities to assist it in this. Meanwhile, in a status report filed in a New York court on April 25, SEC lawyer Christopher M. Colorado told the court that the SEC had sought updates from the Ministry of Law and Justice of the Government of India before filing the report, but has not received any reply yet. The report also said that the SEC has been informed about which lawyer is going to fight this case on behalf of Adani Group and this lawyer has also been sent a request of notice of trial and exemption from the summons of summons. However, no party has yet agreed to exemption service summons and complaint. Significantly, according to reports published in the news media, the Adani Group has put legal firms Kirkland & Ellis and Quin Emmanuel Urkhart and Sulivan to fight the case.
