Justice Gavai’s sharp remarks on demand for President’s rule in Supreme Court, BJP MP’s criticism expressed resentment

New Delhi – A petition has been filed in the Supreme Court demanding the implementation of President’s rule in the state, amid violence in Murshidabad, West Bengal against the Waqf (Amendment) Act. But during the hearing on this petition, the remarks made by Justice BR Gawai of the Supreme Court have now become a topic of discussion across the country.

What is the whole matter?

  • Advocate Vishnu Shankar Jain has filed a petition in the Supreme Court, seeking the deployment of paramilitary forces in Bengal, investigation under the supervision of three retired judges, seeking reports from the governor, and an inquiry into the migration of the Hindu community.

  • The petition states that the situation in Bengal is serious, and the Center should intervene.

Justice BR Gawai’s response

During the hearing, when the petitioner appealed to implement President’s rule, Justice Gavai said in a sarcastic tone: “You want us to order the President? Anyway we are accused of being interfering in the rights of the executive.”

This comment was directly towards the statement which was recently given by BJP MP Nishikant Dubey about the Supreme Court.

Nishikant Dubey’s statement and controversy

  • Dubey had said: “If the Supreme Court has to enact a law, then the Parliament and the Legislative Assembly should be closed.”

  • He even said that Chief Justice is responsible for the civil war.

The statement came in terms of the hearing of the Waqf Act in the Supreme Court, where the Center assured that the disputed provisions would not be implemented till the next hearing.

BJP made distance from Dubey’s statement

  • The BJP has clearly stated that this is the personal opinion of the leaders and the party does not agree with these statements.

  • Rajya Sabha MP Dinesh Sharma had also questioned the judiciary, which the party opted out.

Waqf Law and Bengal Violence

  • Violence has erupted against the Waqf Amendment Act in Murshidabad.

  • According to reports, dozens of families have started migrating due to fear.

  • Earlier, Vishnu Shankar Jain had filed a petition in Bengal for post poll violence on this issue, whose hearing is pending.
