Property dispute: What is the property rights of siblings?

Family property disputes are common in India. Often such quarrels reach the court because many people do not know about property laws. Especially there are many misconceptions between the siblings about the property. Here we are telling what is the right of sister’s brother and parents’ property.

Married daughters are also right in ancestral property

Many women believe that after marriage they have no right to ancestral property – but it is wrong.
After the amendment of the Hindu Succession Act in 2005, daughters have also got authority in ancestral property equal to sons. Whether or not, daughters are equal shareholders in their parents’ property.

What are the rules on parents’ own earned property?

If the parents have made property with their earnings and have been named to one child (eg only daughter or son), then the other cannot make a legal claim on him.
This rule applies to self-cuquired property. In such cases the property owner has the right to give the property.

Is sister entitled in brother’s property?

Under normal circumstances, sister has no right in brother’s property. but if:

  • Brother died
  • He has not left any will
  • And there should not be any class I successor (wife, son, daughter)

In such a situation, the sister can claim brother’s property as Class II successor.

Important rules related to property briefly:

Situation Sister -in -law
Married daughter Full right in parents’ ancestral property
Parents’ own property If written in his name, then the daughter or son who is written is entitled
Brother’s property (without will and class I successor)
