New Delhi: The Supreme Court has advised the Central Investigation Agency ED to ensure that the ED should also take care of the fundamental rights of the people during the legal proceedings. If the ED has fundamental rights, the agency also has to take care of the fundamental rights of others. The Supreme Court gave this advice on the ED to transfer the case of the Civil Supplies Corporation of Chhattisgarh’s Civil Supplies Corporation (NAN) scam to Delhi.

The ED filed an appeal in the Supreme Court under Article 32 of the Constitution, which is generally a paragraph related to personal rights, and demanded to move the entire matter from Chhattisgarh to Delhi. Under this article, any citizen can directly appeal to the Supreme Court to protect his rights. Expressing surprise at the ED’s appeal under this article, the Supreme Court said that if the ED feels that it has fundamental rights, the ED will also have to take care of the fundamental rights of the citizens. A bench of Supreme Court Justice Abhay S Oka and Justice Ujjal Bhuiyan questioned the ED for appeal under Article 32.

The bench said in a mild tone that if the ED has fundamental rights, then citizens also have these rights, which the ED will also have to take care of. Following this comment by the Supreme Court, Additional Solicitor General SV Raju said that the ED also has fundamental rights, along with this, he requested the ED to withdraw the appeal, which the Supreme Court gave permission, so the ED withdrew this appeal filed under Article 32. Earlier, the ED had claimed last year that they are misusing the bail given to former IAS officer Anil Tuteja in the entire case. Based on the complaint of the Chhattisgarh police, the ED has registered a case of money laundering in this entire case and its proceedings are going on in Chhattisgarh, which the agency had demanded to transfer Delhi. The entire case is of February 2015, the scam was done by some officials in the PDS system, Rs 3.64 crore was recovered from the accused.
