Mumbai – In a petition challenging the proposal to establish municipal solid waste treatment and disposal facilities on the land near a school, the Bombay High Court made oral comments that a dumping ground near the school would not be allowed.

The petition filed in 2011 by Avalkheda Gram Panchayat and School in Igatpuri taluka, Nashik, was under hearing. The city council advocate said during the hearing that the Principal Secretary of the Urban Development Department has ordered the treatment plant to be approved after hearing the parties. The petitioners argued that the secretary did not give any reason in the order.

However, the court asked the city council lawyer how a dumping ground could be built near the school. Children have the right to a healthy environment. Children are the future of society. It is the responsibility of the society to provide them a healthy environment, not the garbage. You should say that the decision will be reviewed. We will not allow to create a ground to throw garbage next to the school.

The lawyer said that the proposed site is not for the dumping ground but for the processing plant, and the court said it would investigate the issue. The application was made in 2010. By now an alternative place could be found. The court said that the hearing will be completed on 24 April.
